Software licence
Last updated: [EFFECTIVE DATE]
In short: you may install AMWT on Macs you own or control and use it to recover drives you are entitled to recover. The free version and a paid recovery use the same app; a receipt unlocks all files on the one drive you paid for. Do not resell it, crack it or get around the payment checks. The app only ever reads the drive you scan. Your consumer rights are not affected.
1. This agreement
This licence is between you and Bonny James, trading as AMWT ("we", "us"), [POSTAL ADDRESS]. It covers the AMWT app for Mac and Windows, its updates and its documentation (the "app"). By installing or using the app you accept it. It sits alongside our terms of use and sale. We licence the app to you; we do not sell it. Paddle.com sells paid recoveries as our reseller.
2. What you may do
We give you a personal, non-exclusive, non-transferable, revocable licence to:
- install and use the app on Macs you own or control;
- scan and preview drives, and recover the free allowance (the first 10 files or 100 MB) from each drive;
- for each paid recovery, recover every file the app finds on the one drive the receipt is bound to, and re-scan that drive free for 7 days from purchase.
If you use the app for work, you may use it on your employer's or clients' drives where they have allowed it.
3. What you must not do
- Copy, sell, rent, lend, sublicense or distribute the app, except that you may pass on the free download link.
- Get around, disable or tamper with the payment, receipt or licence checks, or share, forge or alter receipts.
- Reverse engineer, decompile or disassemble the app, except where the law allows it and cannot be excluded.
- Remove or change copyright, trade mark or licence notices.
- Use the app on a drive you are not entitled to recover, or break our acceptable use policy.
4. How the app treats your drive
- The app opens the drive you scan read-only. Its privileged helper, which runs with the administrator permission you grant, has no way to write to a drive.
- It refuses to save recovered files to the same physical drive it is recovering from. Temporary and preview files go to your computer's own disk.
- Your files stay on your computer. The app does not upload file names, contents, thumbnails or scan results.
- Reading a failing drive can still stress it. If the drive is physically damaged, stop and use a professional lab.
5. Internet use
The app works offline for scanning, preview and recovery. It connects to the internet only to open the payment, collect and restore receipts, check for updates, and, if you choose, to sign in to your account or contact support. The privacy notice explains what is sent.
6. Updates
The app checks for updates and installs only updates that carry our digital signature. Updates may fix problems, add features or change how things work, but will not take away a recovery you have paid for while you can still use it under section 2. [CONFIRM: can the user turn update checks off, and are updates installed automatically or on request?] Older versions may stop working with our payment or receipt service if that service changes.
7. Open-source and third-party components
The app includes open-source software under permissive licences, such as MIT, Apache 2.0 and BSD. It contains no GPL-licensed code. The full list of components and their licence notices is on our website at Open-source notices. Those licences, not this one, govern your use of those components on their own.
The app may use features of macOS and Windows, such as the macOS image decoders for HEIC and RAW previews and the Microsoft Edge WebView2 runtime on Windows, which Apple and Microsoft provide under their own terms.
8. Ownership
We, or our licensors, own the app and all rights in it. "AMWT" and its logo are our trade marks. You own your files; we claim no rights in anything you recover.
9. Ending the licence
You can end this licence at any time by deleting the app. We may end it if you seriously break it, for example by cracking the payment checks or using the app on drives you have no right to recover; we will tell you by email if we have your address. When it ends you must stop using and delete the app. Ending it does not affect refunds or statutory rights you already have.
10. Quality, warranty and liability
If you are a consumer, the app must be as described, of satisfactory quality and fit for purpose under the Consumer Rights Act 2015, and nothing in this licence takes away those rights. Beyond them:
- Recovery depends on the state of the drive. We do not promise that the app will find or recover any particular file, and we do not promise it will be free of errors or work with every drive.
- Files are labelled intact only once they have been decoded. Labels for files that are not checked or partly damaged are our best assessment, not a guarantee.
- Our liability to you is as set out in section 12 of the terms of use and sale, including our promise to repair or compensate for damage the app causes to your device or other digital content through our lack of reasonable care and skill.
If you are using the app for business, it is provided "as is" to the extent the law allows, and our total liability to you is limited to the amount you paid for the recovery in question.
11. Export and law
You must follow any export laws that apply to you. This licence is governed by the law of [England and Wales — CONFIRM]. If you are a consumer, you can bring a claim in the courts of the part of the UK where you live, and you keep any mandatory protections of the country where you live.
